These Terms and Conditions ("Agreement") govern the services provided by The House Man ("Company," "we," "us," or "our") to the client ("Client" or "you") for property services, including but not limited to property maintenance, repairs, and improvement services ("Services"). By engaging our services, you agree to be bound by the terms set forth in this Agreement.
1. Scope of Services
1.1. The Company will provide property-related services as agreed upon in writing with the Client, including but not limited to:
1.2. Any services not outlined in the original estimate or contract will be subject to additional charges and must be agreed upon by both parties in writing.
2. Estimates and Payment
2.1. The Company will provide an estimate based on the scope of work discussed. The actual cost may vary depending on the materials, time, and labour required, and any unforeseen issues that arise during the course of the work.
2.2. The Client agrees to pay a deposit outlined in your estimate email to confirm and secure the booking. Final payment is due upon completion of the work to the Client’s satisfaction within 7 days of work being finished.
2.3. Payment methods accepted include bank transfer and cash. If payment is not received within 7] days of completion, the Company reserves the right to charge a late fee of 8% plus the current Bank of England base rate per day until full payment is made.
2.4. Any additional services requested after work begins will be subject to additional charges and must be agreed upon in writing by both parties.
3. Client Responsibilities
3.1. The Client is responsible for ensuring that the property is accessible and that all necessary permissions (e.g., permits for renovations, work orders) are obtained prior to the commencement of work.
3.2. The Client should provide the Company with clear instructions on any preferences, requirements, or restrictions related to the work. The Company is not responsible for any delays or issues arising from incomplete or unclear instructions.
3.3. The Client is responsible for removing or safeguarding any personal property or valuables from the work area. The Company is not responsible for any damage or loss of items not removed from the property.
3.4. The Client must notify the Company of any environmental hazards (e.g., asbestos, mold, lead paint) or other special considerations that may affect the safety of the work.
4. Workmanship Guarantee
4.1. The Company guarantees that all work performed will meet reasonable industry standards for quality and craftsmanship. Any issues related to workmanship will be rectified at no additional charge within 12 months after the completion of the job.
4.2. The guarantee does not cover damages caused by external factors, such as accidents, neglect, weather, or misuse.
5. Materials
5.1. The Company will supply materials for the work unless otherwise specified. The materials provided will be of good quality and suitable for the scope of the project.
5.2. If the Client requests specific materials, the Client agrees to bear any cost difference for these materials and to ensure that they are available for use by the Company when required.
5.3. The Company is not liable for colour discrepancies or variations in material finishes due to lighting, wear and tear, or other external factors.
6. Scheduling and Delays
6.1. The Company will provide an estimated start and completion date for the work. However, delays may occur due to circumstances beyond our control, including weather conditions, delays in material supply, or unforeseen site conditions.
6.2. If there are any significant delays, the Company will notify the Client as soon as possible and provide a revised schedule.
7. Liability and Insurance
7.1. The Company will take reasonable precautions to avoid damage to property during the execution of services. However, the Company is not responsible for pre-existing conditions or damage to the property that is uncovered during the course of work (e.g., underlying structural issues, hidden defects).
7.2. The Company carries liability insurance for accidents, injuries, or damages that may occur on the job site. The Client is encouraged to ensure that their own insurance covers any potential risks to personal property, tenants, or third parties during the work.
7.3. The Client is responsible for maintaining adequate insurance coverage for their property and any tenants (if applicable) throughout the duration of the work.
8. Termination and Cancellation
8.1. The Client may terminate this Agreement at any time by providing written notice. In the event of termination, the Client agrees to pay for all work completed up to the point of cancellation.
8.2. The Company reserves the right to terminate the Agreement if the Client fails to make timely payments or if the work environment becomes unsafe or unsuitable for continued work.
8.3. If the Client cancels or reschedules the work with less than 1 weeks notice, the Company may charge a cancellation fee of £50 to cover administrative and scheduling costs. Materials purchased will be refunded where possible. Any materials unable to be refunded will be given to the customer, however, the cost of the materials will not in this case be refundable.
9. Force Majeure
The Company shall not be held responsible for any delays or failures in performance due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, acts of terrorism, war, or government actions.
10. Dispute Resolution
10.1. Any disputes arising from this Agreement will first be attempted to be resolved through informal negotiation between the parties.
10.2. If the dispute cannot be resolved through negotiation, the parties agree to submit to mediation or arbitration before pursuing legal action.
10.3. This Agreement will be governed by the laws of England and Wales, and any legal actions related to the dispute shall be filed in the courts of England and Wales.
11. Privacy
11.1. The Company is committed to protecting the Client’s privacy. Personal information collected will be used only for the purpose of providing the requested services and will not be shared with third parties unless required by law.
11.2. The Company may contact the Client via email, phone, or other communication channels for updates, billing, or marketing purposes, but the Client can opt out at any time by notifying the Company.
12. Miscellaneous
12.1. These Terms and Conditions constitute the entire Agreement between the Client and the Company. Any changes or amendments must be made in writing and signed by both parties.
12.2. If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement will remain in full force and effect.
